Not sure that's an absolute - for example the Croxley Link would have required some new, and a lot more reinstated, live rail. Possibly a special case given that it's buried deep under ground, but the Northern Line Extension also includes new live rail.

You are right, I had misremembered what I read - the ORR say "There is a presumption against the reasonable practicability of new-build or extended DC third rail in view of the safety requirements duty holders must satisfy in order to justify the use of third rail." ORR leafletI can't imagine a tourist railway (where people will be expected to wander about like headless chickens and go towards the dangerous bits), would get the nod. I assume the Croxley link was on the basis of Grandfather rights as much as anything

Grandfather rights only apply along as they are being used, so there is no possibility of the Croxley link getting them (assuming it's ever built of course). However new third and fourth rail systems can be built and existing ones extended as long as the duty holder can persuade ORR that there it is the only practical option. See for example Shoreditch High Street to Highbury and Islington.
The presumption just means that if you want to use third or fourth rail you need to actively convince the ORR there is a reason they should let you, whereas you don't need to justify your choice of OHLE.

In answer to Chris M - take your point about Grandfather rights only where used (although query what "used" in that context is - has the line been formally abandoned?) Incidentally AIUI mailrail is battery operated.
